GENERAL CONDITIONS OF SALE
SUBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION
Iannamico Francesco snc reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated, to the Customer in any way.
By "online" purchase contract we mean the distance contract, that is the legal transaction concerning movable goods and / or services stipulated between a supplier, Iannamoco Francesco snc and a customer within a distance selling system organized by supplier who, for this contract, uses remote communication via internet, e-mail or fax.
The contracts, therefore, will be concluded through the means indicated above (internet, e-mail, or fax), following the procedures indicated on the website www.iannamicoliquori.it for the purchase of the goods. Iannamico Francesco snc will be able to request a confirmation of the order made to the customer.
For distance contracts with consumers, the legislation envisaged by section II of Legislative Decree no. 206 of 6 September 2005.
SALES PRICES AND PURCHASE METHODS
All sales prices of the products displayed and indicated on the website www.iannamicoliquori.it, for which they constitute a public offer pursuant to art. 1336 of the Civil Code, are inclusive of I.V.A. and any other tax; the cost of transport is duly highlighted on the page within the site that the customer will take care to view before confirming the purchase. The purchase contract is concluded through the exact compilation and the consent to the purchase expressed through the "online" subscription or by sending the order form by fax or e-mail, or by e-mail. The customer can pay for the goods ordered using the payment rules indicated online at the time of purchase. Iannamico Francesco snc reserves the right to request payment by bank transfer or other payment methods deemed to be safe.
EXECUTION OF THE CONTRACT AND METHOD OF DELIVERY
Iannamico Francesco snc will arrange to have the selected and ordered products delivered to customers, in the manner described in the previous article, by trusted couriers and / or shippers. In the absence of the recipient at the time of delivery a notice will be left and the customer must personally contact the courier or shipper as soon as possible, in order to agree on the delivery methods. The delivery times, which will never exceed, in any case, those provided by the art. 54 Legislative Decree 206/2005, may vary from one week to ten working days. The aforementioned delivery times refer to the products in stock at the time of the order. In the event of immediate unavailability of the products, it will be communicated via e-mail. The delivery will be carried out by the carriers mainly at street level. However, no responsibility can be attributed to the supplier for late or non-delivery due to force majeure or unforeseeable circumstances.
AVAILABILITY OF PRODUCTS
The customer can purchase the products indicated in the electronic catalog prepared (present on the site www.iannamicoliquori.it) and in the quantities existing in the warehouse. If an order exceeds the quantity existing in the warehouse, Iannamico Francesco snc will inform the buyer if this product will or will not be available in the future and the time required for procurement. In the event that a product is available, even if it is not actually due to problems with updating the site, reimbursement by bank transfer of any payment already made is envisaged. Since the simultaneous access of many user-clients and the simultaneous possibility of "online" orders modify the availability of the product, Iannamico Francesco snc does not guarantee the certainty of assignment of the ordered goods.
BUYER'S OBLIGATIONS
The consumer undertakes and commits, once the purchase procedure has been completed, according to the procedures indicated, to print and keep the present general conditions, which, moreover, will have already viewed and accepted as a necessary step in the purchase , as well as the specifications of the product being purchased, and this in order to fully satisfy the condition of the articles 4, 5, 52 and 53 of the Decr. No. 206/2005. it is strictly forbidden for the purchaser to enter false, and / or invented, and / or fantasy data, in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively their own real personal data and not of third parties, or of fantasy. BUYER'S OBLIGATIONS

The Customer relieves Iannamico Francesco snc from any liability deriving from the issue of incorrect tax documents due to errors relating to the data supplied by the Customer, being the Customer solely responsible for the correct entry.
AUTHORIZATION
By completing the order form, the consumer and / or customer authorizes Iannamico Francesco snc to communicate non-sensitive personal data (residence, telephone number) to trusted couriers and / or forwarding agents used to deliver the goods purchased in order to allow the procedures necessary for their delivery.
RESPONSIBILITY'
The consumer and / or customer from the moment he receives the damaged goods or requests their return to the carrier has direct and exclusive action against the carrier itself. The latter is also responsible for the delay in delivering the goods to the recipient. Iannamoco Francesco snc, in such cases, must be considered exempt from any liability for loss or damage (damage) of the goods from the moment in which it is delivered without reservation to the carrier for transport. In the event of damage to the packaging or packaging, the Customer is responsible for making reservations with respect to the things transported at the time of delivery upon penalty of forfeiture. In the event of partial loss or damage that cannot be recognized at the time of return, the consumer and / or customer must report the newly known damage to the carrier within eight days of receipt by registered letter with return receipt. (art. 1698 c.c.) The product images published on the site are purely indicative. In the absence of specific indications in the order notes the lack of conformity of the purchase cannot be complained.
RIGHT OF WITHDRAWAL
The buyer has the right to return the goods within 10 days after receipt.
The buyer may enjoy additional rights based on the provisions of the Distance Selling Regulations pursuant to Legislative Decree 22 May 1999, n. 185.
Return Details:
According to the D.L. 15 January 1992 n. 50, the purchaser can avail himself of the right by giving notice by registered mail with return receipt to be sent to IANNAMICO FRANCESCO SNC- VIA TINTORIA, 1 - TARANTA PELIGNA (CH) within and no later than 10 days from the date of receipt of the goods.
In case of applicability of the right of withdrawal, the buyer is obliged to return the goods to IANNAMICO FRANCESCO SNC - VIA TINTORIA, 1 - TARANTA PELIGNA (CH) at his own expense as received and that is absolutely intact in the original packaging. Failure to comply with these principles makes the right of withdrawal inapplicable. And authorizes Iannamico Francesco snc to withhold 40% from any refund.
In case of application of the right of withdrawal, once received the goods, which will be viewed, if found intact and without any damage, we will refund the amount paid by the customer, excluding shipping costs, within the shortest possible time and maximum within thirty days from the date on which the communication was received, using the following methods: bank transfer or replacement of the item with other goods chosen by the purchaser.
Subjects not classifiable as consumers are excluded from the legislative decree, that is who executes an order indicating the VAT number for the invoice.
COMPLAINTS
Any complaint must be sent via email. The Customer will receive an e-mail confirming the opening of the complaint within the next five working days; the same communication will provide instructions for defining the procedure and forward requests for clarification or documentation.
CONTRACTUAL RESOLUTION AND EXPRESS TERMINATION CLAUSE
Iannamico Francesco snc has the right to terminate the contract by giving simple communication to the consumer and / or customer with adequate and justified reasons; in this case the customer will only be entitled to a refund of any sum already paid.
ASSIGNMENT AND TREATMENT OF PERSONAL DATA
Personal data is collected for the purpose of registering the customer and activating against him the procedures for the execution of this contract and the related necessary communications; these data are processed electronically in compliance with the laws in force and may be exhibited only upon request of the judicial authority or other authorized authority authorized by law. Personal data will be communicated to subjects delegated to carry out the activities necessary for the execution of the stipulated contract and disseminated exclusively for this purpose. The Customer expressly undertakes to provide Iannamico Francescosnc with copies of the identity documents deemed necessary for the purpose of any checks. Failure to comply with the aforementioned request authorizes Iannamico Francesco snc to immediately terminate the contract for non-fulfillment.
The processing takes place, also with the aid of electronic means, in compliance with the procedures that the art. 11 of Legislative Decree 30 June 2003, n. 196 sets the user's guarantee and, in general, protecting his rights, fundamental freedoms and dignity, with particular reference to privacy and personal identity. The processing will take place for a period not exceeding that strictly necessary for the fulfillment of the aforementioned purposes. Personal data will not be disclosed to third parties.
JURISDICTION AND JURISDICTION
Any dispute concerning the application, execution, interpretation and violation of purchase contracts stipulated "online" via the website is subject to Italian jurisdiction. Except for the cases provided for by art. 63 of Legislative Decree no. 206/2005, any dispute between the parties regarding the application, execution, interpretation and violation of this contract will be the exclusive responsibility of the Court of Lanciano.
